DECISION OF THE MINISTER OF NATURAL RESOURCES AND ENVIRONMENT
Stipulating Functions, Duties, Powers and Organisational Structure of
the Department of Geology and Minerals of Vietnam
THE
MINISTER OF NATURAL RESOURCES AND ENVIRONMENT
- Pursuant to Decree No 91/2002/ND-CP dated 11 November 2002 of the Government stipulating functions, duties, powers and organisational structure of the Ministry of Natural Resources and Environment;
- At the proposal of the Director General of the Department of Geology and Minerals of Vietnam and the Director General of the Organisation and Personnel Department,
DECIDES
Article 1. Position and Functions
The Department of Geology and Minerals of Vietnam is an organisation directly under the Ministry of Natural Resources and Environment, has the function to assist the Minister in conducting State management over geology and mineral resources, including: basic surveys and research of geology, mineral resources and mineral activities (mineral prospecting, exploration, exploitation and processing), protection of mineral resources; to organise the implementation of basic surveys and research of geology and mineral resources, and prospecting for discovery of mineral deposits, throughout the country.
Article 2. Duties and Powers
1. To submit to the Minister of Natural Resources and Environment legal documents on management, protection, basic survey of geology and mineral resources, and mineral activities;
2. To submit to the Minister of Natural Resources and Environment strategies, development schemes long-term, five-year and annual plans, -; procedures, specification, standards of research, basic surveys of geology, minerals and mineral activities;
3. To submit to the Minister of Natural Resources and Environment regulations on delegating powers to various levels in respect of basic geological surveys of mineral resources and geological mapping, determining untapped areas of mineral resources, toxic minerals; delineating areas with restriction of mineral activities, areas subject to bidding for mineral activities and areas with prohibition or temporary prohibition of mineral activities;
4. To submit to the Minister of Natural Resources and Environment regulations on the authorities to grant, extend and withdraw permits for mineral activities; procedures of the grant, extension, withdrawal and approval of the return of permits for mineral activities and procedures of approval of transfer and bequest of rights of mineral activities;
5. To submit to the Minister of Natural Resources and Environment for decision on the grant, extension, withdrawal, approval of the return of permits for mineral activities, approval of the transfer of rights of mineral activities, and for approval of areas for artisanal mining under the competence of the Ministry.
6. To organise and direct the subordinate units of the Department to implement the duties and plans on research, basic surveys of mineral geology, environmental geology, hydrogeology, engineering geology, urban geology, rural geology, geohazards, geothermal energy and prospecting for minerals and discovery of new mineral deposits;
To organise the implementation of application of advanced sciences and technologies to the basic geological survey and mineral activities;
7. To register and assemble data, to manage the results of basic geological surveys of mineral resources and mineral activities; to make an inventory and statistics of reserves and quality of mineral resources; to archive and manage documents and samples in relation to geology and mineral resources and to keep in confidentiality the data and information on geology and mineral resources;
8. To take the lead or participate in the appraisal of projects and reports on basic geological surveys and mineral activities; to certify the legality of geological and mineral data and samples, and non-commercial minerals to be remitted abroad;
9. To carry out public awareness campaigns, disseminate information, provide instructions and inspect various sectors, localities, organisations and citizens in the implementation of the law on geology and minerals; to provide technical and professional instruction on geology and minerals to bodies in charge of State management of natural resources and environment in provinces and cities directly under the Central authority.
10. To settle or take part in the settlement of disputes, claims, denunciations in relation to basic geological surveys of mineral resources and mineral activities; to give response to organisations and individuals in respect of geology and minerals according to the assignment by the Ministry;
11. To implement international co-operation programs and projects and to represent the geological and mineral sector of Vietnam to take part in international activities in the field of geology and minerals according to the assignment by the Ministry;
12. To maintain the relationship with associations, non-government organisations, follow up and report to the Minister of Natural Resources and Environment on activities of associations, non-government organisations in the field of geology and minerals;
13. To manage activities related to geological and mineral service and other services carried out by subordinate units of the Department in accordance with the provisions of the law.
14. To manage and use efficiently financial sources and properties allocated by the State; to manage capital construction investment projects in accordance with the provisions of the law and the assignment by the Ministry;
15. To manage the organisation, staffing and organise courses of training and intensive improvement of technical and professional capabilities for officials, employees l of the Department as assigned by the Ministry.
16. To make statistics and prepare periodical and immediate reports on the implementation of the assigned duties
17. To implement other tasks as assigned by the Minister of Natural Resources and Environment.
Article 3. Organisation of the Department
a) The Board of Directors of the Department of Geology and Minerals of Vietnam shall be composed of a Director General and some Deputy Directors General
The Director General shall be responsible before the Minister for the assigned duties, elaborate work regulations and manage all activities of the Department; define the functions and duties of the subordinate units of the Department.
The Deputy Directors General shall be responsible before the Director General for the fields of work assigned to them.
b) Units assisting the Director General:
1. Administrative Office;
2. Organisation and Personnel Division;
3. Planning and Finance Division;
4. Mineral Policy Division;
5. Geological Division;
6. Mineral Division;
7. International Co-operation Division;
8. Mineral Branch of Central Region (based in Da Nang city);
9. Mineral Branch of Southern Region (based in Ho Chi Minh city); and
10. Mineral Inspectorate.
c) Non-business Subordinate Units of the Department:
1. Northern Geological Mapping Division;
2. Southern Geological Mapping Division;
3. North-eastern Geological Division;
4. North-western Geological Division;
5. North Central Geological Division;
6. Mid Central Geological Division;
7. Northern Hydrogeological and Engineering Geological Division;
8. Central Hydrogeological and Engineering Geological Division;
9. Southern Hydrogeological and Engineering Geological;
10. Radioactive & Rare Earth Minerals Division;
11. Geophysical Division;
12. Intergeo Division;
13. Geodetic and Topographic Division;
14. Marine Geology Division;
15. Centre for Geological Analysis and Experiment;
16. Centre for Geological Information and Archive;
17. Museum of Geology;
18. Journal of Geology.
The Department of Geology and Minerals of Vietnam shall be a level II cost accounting unit, having its own seal, and may open its own account at the State Treasury and the bank. The Mineral Inspectorate, the Mineral Branches and non-business subordinate units of the Department shall have their own seals and may open their accounts according to the regulations.
Article 4. Effective Date and Implementation
Responsibility
This Decision shall come into effect from the date of signing
The Director General of the Department of Geology and Minerals of Vietnam, the Director General of the Organisational and Personnel Department, the Heads of organs and units directly under the Ministry shall be responsible to implement this Decision.
